My b/f’s ex-wife is in contempt for non-payment of IRS debt as stipulated in their divorce decree. They have had their 1st court hearing at which she was told she must have a payment plan in place by the time they return to court. Now she has filed chapter 7 bankruptcy and listed him as a creditor. The IRS is garnishing his wages at this time. Will she be able to have this debt discharged? Can the judge override this? That would leave him 100% responsible for the debt unless he fights it at the bankruptcy hearing.
